Here & Away operates a travel platform that curates and showcases unique hotels, vacation rentals, and other accommodations. The primary purpose of the Platform is to provide travelers with access to information about distinctive properties, enabling them to make informed decisions when choosing where to stay. In addition, we facilitate connections between travelers and property owners or third-party booking platforms but do not directly handle bookings or any other transactions. All bookings, agreements, and related arrangements are made exclusively between the traveler and the respective property owner or booking platform, and Here & Away is not a party to those agreements.

Here & Away also operates an online store featuring curated travel-related merchandise and items that reflect the spirit of travel. All purchases made through the store are subject to these T&C. The store is operated directly by Here & Away, and all transactions, including payments, refunds, and order fulfillment, are managed by Here & Away or our third-party fulfillment partner. We do not store any credit card information; payments are processed securely through third-party payment processors. Additionally, all orders are shipped directly by our on-demand fulfillment partner, which handles the shipping and delivery of all products. Some items may also be offered through affiliated links, and purchases made through those links are fulfilled and handled entirely by the third-party partner. For any issues related to store purchases, including product availability or delivery, customers should contact Here & Away directly or reach out to the third-party fulfillment partner, as applicable.

3. Property Listings and Accuracy
The accommodations presented on the Platform are based on information provided by property owners or third-party affiliates. While we strive for accuracy and ensure that the content is updated regularly, the property owners are solely responsible for ensuring that all details, including availability, pricing, amenities, and images, are accurate and current. Here & Away does not guarantee the accuracy, completeness, or reliability of any listings, and we shall not be held liable for any discrepancies, errors, or changes in the information provided by property owners. Users are encouraged to verify details directly with property owners before making any arrangements.

4. Intellectual Property
All content found on the Platform, including but not limited to text, graphics, logos, images, videos, and website design, is the intellectual property of Here & Away or its licensors. This content is protected by copyright, trademark, and other intellectual property laws. Users are prohibited from using, copying, distributing, or reproducing any content from the Platform without explicit permission from Here & Away or the relevant copyright holder.

The images displayed on the Platform are the property of the respective property owners, and Here & Away has obtained authorization from the owners to use these images for promotional purposes. Users may not use or reproduce these images without prior consent from the respective property owner.

We are not involved in any transactions between travelers and property owners, and we do not handle payments, cancellations, or disputes. Therefore, we are not liable for any issues that arise from bookings made through the Platform, including but not limited to:

  • Cancellations, delays, or changes to bookings.

  • Property conditions, amenities, or services.

  • Disputes or disagreements between travelers and property owners.

In addition, Here & Away is not responsible for any issues arising from purchases made through the online store, including but not limited to product availability, shipping delays, or returns. Any concerns regarding bookings, accommodations, or store purchases must be addressed directly with the respective property owner or Here & Away.

8. Changes to Terms & Conditions
Here & Away reserves the right to update, modify, or amend these T&C at any time without prior notice. Any changes will be effective immediately upon posting on the Platform. It is the user’s responsibility to review these T&C regularly to stay informed of any updates. Continued use of the Platform after any changes to the T&C constitutes acceptance of the revised terms.

9. Governing Law and Dispute Resolution
These T&C are governed by the laws of the state of Florida, USA. Any disputes arising from the use of the Platform or these T&C shall be resolved through binding arbitration in Miami-Dade County, Florida. Users consent to the exclusive jurisdiction and venue of the courts in Miami-Dade County for any legal action that may arise from the use of the Platform.
